This development is in keeping with similar new homes in the area. The design makes good functional use of the site and includes significant use of passive solar design.

Care and attention has been made so as to minimise the overlooking into adjacent properties and the proposed screening will produce valuable relief to the western facade which will enhance the appeal of the building.

It’s nice to see investment in independent architecture rather than just a cookie cutter from a volume builders catalogue

Child Safe issues paramount. In particular Child safe 5.61 and 5.62 are most relevant.
• Overall height of the proposal – planning policy affecting the site suggests that the site should have a maximum height of 14m. The part of the proposal which interfaces with the eastern boundary of the school, ranges between 21-18m (above natural ground level). This would make it one of the tallest buildings in Bayside.
• We note that there is no real policy justification/encouragement for increased residential densities. We question the justification for additional residential development above the preferred height limit.
• Both buildings proposed will cast shadows in the morning across the oval – resulting in limited sunlight and vitamin D for our students.
• This space should be treated more like public open space rather than a view for an 8 level apartment building.
• The height of balconies should be as high as possible in order to avoid overlooking. The current proposal for 60cm wide planter boxes is insufficient to provide any real privacy for our students and the school community.
• Building B alongside our oval, is proposed to be built considerably closer to its western boundary than its eastern. There is an argument that the school’s interface is sensitive and greater setbacks should be provided.
• Overlooking the oval – Building B is entirely orientated towards the west with all proposed apartments facing the school.
• The apartments are in close proximity to the school boundary – this separation should be increased to a minimum of 4.5m – this is a distance that is typically used in residential circumstances.
• The sketches provided to the school have 5 levels whereas the proposed development is 8 levels high, which is deceiving and inaccurate representation.
• School programs other than school days included a Japanese Saturday College with over 260 students each Saturday as well as the 'Their Care' Holiday programs in vacation times will also be adversely effected by the proposed development.
• If the development goes ahead, Bay Road traffic will increase considerably and with half of our school community entering and exiting through Bay Road laneway this will be a safety risk of great concern.
• The Sandringham Children’s Centre is almost diagonal to the proposed development and Genius Child Care (Kids Company) is just over Bluff Road 9 in Bay Road. There is a high risk with smaller children involved as well as traffic and parking concerns.
• There is a strong risk that the viability of the School will be compromised if enrolments decline because of the perception of parents that the apartments pose a risk through overlooking onto the oval.

I object to this application, given the are is sufficiently services by packaged liquor outlets as well as a variety of restaurants/cafes and bars which also serve on the premises.
This application is not in keeping with the Council's vision for the Black Rock Village and should be rejected for a second time. If approved this will damage the local appeal of the shopping precinct through increased traffic, increased take away liquor sales and potentially exacerbate the existing issue of teenage drinking and parties in the beachside park and foreshore.
Diversity of the retail offerings should be considered in line with the Council's vision for the village and well-being and wishes of the community.
This application should be rejected.

There's no way Bayside Council will go close to meeting stated Tree Canopy and climate emergency policy goals if it allows the continual removal of established trees that are viable specimens, currently provide shade, amenity and habitat.

Bayside is dying by a thousand cuts (trees) a year. It's got to stop.

How does anyone think that removing 5 protected trees from a block is acceptable! The trees on this block are in great health and would effect the wild life, climate emergency policy and urban forest strategy. This needs to be rejected as allowing these 5 healthy VPO 3 protected trees to be removed unnecessarily is obscene!!!! If you want to build a development choose a block that doesn't have VPO 3 trees on the block!

As a Black Rock resident for 35+years, I strongly reject this application.

I consider myself a balanced and supportive shopper - I shop at all three local village community liquor stores and I also travel to Dan Murphy’s Cheltenham.

I am mystified and mortified the Bayside City Council would even consider permitting a national chain liquor shop amongst the local village liquor shops - one of them is ONLY 5 DOORS AWAY from this site!!

This is wrong from many aspects: unfair competition, does not support local businesses, increased traffic, community and teenage alcoholism, let alone the potential increase rubbish and alcohol violence at the foreshore during summertime.

Let nationals compete with the nationals (as per Sandringham, Hampton and Southland etc). A national chain does not provide Black Rock any benefits.

Why do we need a Dan Murphy store in Black Rock shopping village. We already have 3 boutique bottle shops in the village.. a big Dan Murphy will have a huge impact on parking/traffic and our local shops.. I strongly oppose.

As a long time Black Rock resident I do not support this Re-application for a liquor store owned by a large company.
The two family run liquor stores have served our community well and the bayside residents love to support the local businesses.
We have no need, or desire for another huge retail owned store in Black Rock.
Please consider the locals and our concerns and listen to us.

Along with most people I’ve spoken to in our postcode, I oppose the opening of Dan Murphy’s in Black Rock. We already have a number of boutique bottle shops that service the neighborhood well, and Dan Murphy’s Cheltenham just around the corner. It is overkill to open another big scale bottle shop - we need diversification of shopping opportunities in our little village.

Please do not approve this repeat application from a large retailer with an established outlet only a few minutes away.
It is imperative that Bayside retains its “ village “ and local community character as this is one of the community strengths.The proposed application is unnecessary given the existing family businesses in the locale selling alcohol supported by locals
The location and surrounding restrictions do not facilitate deliveries or servicing of the intended large scale enterprise
Please consider the strength of feeling evident amongst the residents and engage with them

Black Rock village already has 3 other alcohol outlets! In such a small neighbourhood shopping area we do NOT need a 4th! Apart from the fact it would ruin the present day shopkeepers livelihood, it would put considerable stress on all the already limited parking available due to the attraction of the Woolworths supermarket directly across the road from this location. I believe I already have enough choice from my "local" - or I can drive 4 kms and visit the Dan Murphy shop in Bay Road! As a rate payer I object to the fact that our council already said a big fat NO to Dan Murphy's money grab - and yet here we are fighting this again. Please everyone, get behind our beautiful village and ask them to leave our little shopping centre in peace.

I completely object to the proposed Dan Murphy's development in Black Rock Village. The authenticity of the village is in direct threat to this proposed planning application and should be be strongly rejected. The area already hosts three independent bottle shops that are congruent to the area. The authenticity of the Black rock village is now at risk of such developments and are a significant concern to the local residents. Similar developments of Acland Street St.Kilda over the last decade have forever damaged the unique characteristics of the street, and as a local resident, I am concerned that Black Rock will now follow a similar path.

We don't need this size liquor store in our little village. We struggle now to find a carpark to go to the small group of shops . We already have 3 businesses to purchase from in the village of Black Rock.
This area streams with young people and families in the warmer months enjoying the outdoors and beach. Why encourage youth tp drink and cause problems for the police and ruin the Village ambience for families

I am strongly against this application

1. In the Sumer many people visit out beaches and foreshores and there is an increasing presence of young (underage) people drinking in these areas. I am concerned that another liquor store will increase the liquor consumption on our beaches and foreshore

2. There will be in increase in littering due to the above point

3. There is already a large Dan Murphy’s less than 5km away in Cheltenham

4. there are already 3 liquor outlets in the village who are local traders and their livelihoods would be threatened by this proposal.

5. Blank rock needs diversity in its stores to keep the commercial viability of the area to attract businesses and visitors to the area.

6. This could be an ideal location for a council lead initiative for a conservation visitors centre, a small business centre, an arts collective…… or some other communy focussed outlet that brings people to the area. Boosti g trade for everyone

There are currently two stand alone “bottle shops” plus a licensed grocer in Black Rock Village shopping area.
The grant of approval for a fourth packaged liquor outlet in a suburb with a little over 6000 residents (2016 census) would be borderline corruption by whichever government body or court made such a grant.
Endeavour Group own Dan Murphy’s and BWS liquor and either own or lease the site at 40 Bluff Road, and it was their business decision to move theMetro store across the road. They are big business and must absorb the cost of the empty store at 40 Bluff Road, not recoup their losses by forcing locals to accept an unnecessary and unwanted fourth packaged liquor outlet.
The car park next to the Woolworths Metro is always full and the car park next to 40 Bluff Road already Carrie’s the overflow from the Metro store.
A liquor outlet at 40 Bluff Road would create hundreds of extra car parking movements each day in an already very busy area.
Any application for a big box style store must surely be rejected.

We DO NOT need another bottle shop in Black Rock, and I echo the sentiment from other residents about adverse effects such as parking, footfall on already eroded paths, impact on small local family businesses and an existing 4 bottle shops within 150 metres. There is already a huge Dan Murphys store on Bay Rd right around the corner…. cannot understand why putting one at 40 Bluff Road makes any sense??!!?? Lack of parking sees all side streets Bluff Rd and Balcombe Rd already congested (summer is the worst when this combines with beach goers), this proposed development has not been thought through especially how it will negatively impact our local community.

There is no need for another large liquor retailer in Black Rock as there are two outlets already selling alcohol in the local village. A national retailer would be detrimental to the area and affect local businesses and this would impact the community. There is a very large Dan Murphy store within 5km of the proposed site. Increased traffic would be a hazard to other road users and pedestrians, and parking would be even more difficult. I understand a previous application has already been rejected.

The area where the application is for is already congested with traffic from the new Woolworths .
There is minimal parking available and from observing other Dan Murphy Stores they become extremely busy on weekends and public holidays .
This would be disastrous for Black Rock Village .
Also when considering this application has the council thought about the large volume of trucks that would be around delivering supplies to the store !!!!!!!!!!
And above all , if I want to purchase Liquor in Black Rock there are already 3 outlets …………. So why ?????
