- - STAGED SUBDIVISION OF LAND (PS 909388D) - SUBDIVISION OF LAND ADJACENT TO A ROAD IN A TRANSPORT ZONE 2 - CREATION OF CARRIAGEWAY EASEMENTS The site is subject to a development permit P666/2022 which allows for the construction of a mixed use retail development. This planning permit application proposes to subdivide the land in accordance with development permit P666/2022. It is noted that the development permit P666/2022 is subject to two current S.72 amendments to facilitate the further development of Lots S2 and S3 on the POS, but these amendments will have no impact on the granting of this staged subdivision permit. We note also that this application has been lodged previously (P184/2024 - lapsed) and the information below seeks to answer questions raised in the previous RFI process. Item 1 - additional Fees - please make the invoice out to the Applicant Item 2 - Proposal description amended above Item 3 - There is no need to amend the POS to include the creation of easements as a purpose of the plan, as it is implied by the easement table in which the easements are created. Item 4 - Staging Plan has been amended and included within this submission showing the two stages proposed for the development. No further subdivsion of Lot S3 is proposed as part of this subdivsion permit application. Item 5 - S.173 agreement has been uploaded with this application. Item 6 - Development Permit P666/2022 have been re-endorsed since the previous RFI date 22nd May 2024. The POS submitted for endorsement in this subdivsion application accords with the approved development plans. Item 7 - The car parks adjacent to Food 3 and the convenience store are provided to meet the car parking requirements for these tenancies. Food 2 also relies on some of the parking adjacent to Food 2 to meet its car parking requirements. Requiring the carparks to be located within the Common Property will be at odds with the requirements of development permit P666/2022. Item 8 - Proposed Street Names in order of preference: Wattle Place; Sunshine Place, Brimbank Close Council Drainage RFI - See agreement from DPT attached to this application. A creation of easement plan has also been prepared and lodged with Land Registry Services Victoria.
