NOTICE OF OBJECTION TO THE PROPOSED Modification to Restrictive Covenant at 17 Dawson street Reservoir

Am writing to formally object to the application made to remove or modify the restrictive covenant on 17 Dawson street Reservoir 3073 for the following reasons:
As a beneficiary feel compelled to express my concerns regarding the potential impact of this proposed modification as I will be personally impacted by any decision to vary the covenant..
The single dwelling covenants in this part of Reservoir are a unique feature that attracted me to choose to live in this area. These covenants play a significant role in preserving the lifestyle and character of the neighborhood, which is why I am deeply invested in upholding them. Any modification or overturning of this covenant would not only set an irrevocable precedent but also see further developments that would fundamentally change the essence of the community we have come to cherish.
I firmly believe that any alteration to the single dwelling covenants would cause substantial personal injury to me and other beneficiaries of the Merrilands Estate. It is crucial to understand that these covenants are not just legal binding agreements between residents but integral to the fabric of our community and the quality of life we have chosen to embrace.
I sincerely hope that you appreciate the significance of our objection and reconsider the implications of the proposed modification. Preserving the integrity of the single dwelling covenants is essential to maintaining the essence of the Merrilands Estate and the values we hold dear.

I am writing to formally express my strong objection to the proposed removal of the property covenant for the development of multiple dwellings in our estate. As a resident and homeowner within the community, I believe such a decision would have detrimental effects on the overall quality of life and character of our neighborhood.

Furthermore, the environmental impact of such a development cannot be overlooked. Increased urbanization not only threatens local ecosystems but also contributes to climate change through higher carbon emissions and reduced green spaces. I support this application as the blocks of land is this part of Reservoir are quite large, so two dwellings on the site seems reasonable. It will also help encourage newer dwellings to be built, which will help ensure the area doesn't start to become 'scummy' as a lot of the dwellings are getting older (circa 1960's to 1980's) and are being retained and in many cases are not being renovated because of restrictive covenants like these making redevelopment an unviable option.

I would like to express my objection to the application to vary the restrictive covenant at 17 Dawson Street Reservoir. My wife and I bought our home in the Merrilands Estate a few years ago and what attracted us was the tranquility and the general absence of multi unit developments that are common in other parts of Darebin. We highly value the existence of the covenant on our property and on other properties throughout the estate and the function it serves to protect the estate’s ongoing integrity. The covenant was a major positive factor in the decision when we bought our home. I am not against development and there is plenty of land for sale where multi dwelling construction is not so restricted. Anyone who has bought property with this type of covenant on the title knows exactly what it means at the time of purchase. Variation of the covenant would cause me injury and the application should be refused.

I object to the variation to this Covenant in relation to the planning application for 17 Dawson St Reservoir.
Unfortunately, as mentioned by another previous objection, this was and still is stated on the title at the time of purchase, for this and any other property for that matter which falls within the Merilands Estate covered by this unique Covenant.
If you wanted to develop and build more than one dwelling on a property then you should've bought a block where no such Covenant exists and there are no such restrictions.
Some residents have been living here for many years, or have just moved in to this area and have enjoyed the uniqueness of this Covenant and the fact that their streets are not overloaded with cars and rubbish or anything else that comes with overcrowded streets.
More dwellings is attractive to Darebin council as it can collect more rates but in reality it does nothing to support it's current residents with road surface or footpath issues.
All we need now, in and around Radford Rd, is more trucks (including B-Doubles) and more resident vehicles jamming up our otherwise quiet streets.
Plenty of land further out where you can develop into multi dwelling and you won't have any restrictions!
Also, some of these homes have character and are a perfect example of the architecture for the era and should be protected. They are very well built and perfect to renovate or extend.

If you are a beneficiary of this covenant which I want to get varied, then please prove that you are a beneficiary.

Also, how can you say in your objection, there'll be personal injury to you, when you reside 2km away from this address? In my opinion this is ridiculous.

My property is a registered and licensed rooming house, in which I'm legally allowed to have 12 tenants and 11 rooms. All I want is to have 4 additional single rooms built in my existing garage.

I want to vary my covenant from having a single dwelling on the proerty, to a second dwelling on the same property. NOT and multiple storey dwelling.

To all those people who objected to my application to vary my covenant, why do you write in your comments the details for your injury caused if I got the covenant varied. Do you complain about the block of units just up from my place?

The owner of this property is being sued for extreme negligence. It’s not a good idea to allow him to add more rooms to this property. He has a mental disorder and takes responsibility for nothing. He’s only about packing more people in to the place,, with zero regard for their living conditions. The people living there are in a vulnerable state, and he takes advantage of the situation. He cares only about how much money it brings in. Nothing else.
